MooPig Cage Match #42 :: Farmers vs Golfers

Till the Soil
Touted by Dave Darnell  |  Apr 15, 2013  |  Bryan TX

Farmers

--Vs--

Golfers

BACK STORY

Roam over large fields, beat at the ground with long sticks, plant a seed, farmer's tan on sleeves and brow: while the modern game of golf originated in 15th century Scotland, the game's ancient origins are unclear and much debated. Some historians cite chuiwan ("chui" means striking and "wan" means small ball) as the progenitor, a Chinese game played between the eighth and 14th centuries.

A Ming Dynasty scroll dating back to 1368 entitled "The Autumn Banquet" shows a member of the Chinese Imperial court swinging what appears to be a golf club at a small ball with the aim of sinking it into a hole. The game is thought to have been introduced into Europe during the Middle Ages. (LINK)

Chui wan (strike pellet), one of the colorful ball games in ancient China , is believed to be the origin of golf, a modern outdoor game. The club, ball, course and rules of cui wan were almost the same as those of the modern golf. In Europe, the game of golf was first seen in paintings of the 14th and 15th centuries, but that was several hundred years after the Chinese games of chui wan. (Kaleidoscope. no date. HERE)

Like most things that become fashionable, a monarch observes some peasants out in a field doing something and presto the politicians in court copy them. This "pellet" hitting with "sticks" game could have its origins in something peasants were doing while farming.

WHILST' IN AMERICA

Jim Healey, July 2003 | Golf Club Atlas: EXCERPT | " ... In late 1894, following the construction of America’s first and oldest eighteen-hole golf course, Chicago GC, Charles Blair Macdonald wrote to Robert to come to America for the position of golf professional at his new course.

" ... Macdonald and the Foulis’ had met when he was a student at St. Andrews University, where Macdonald lived with his grandfather, and had obviously thought highly of their skills. Robert, who was still under contract to Ranfurly, would not think of breaking his commitment to them, so in his place he recommended his older brother Jim.

" ... Jim had learned his golf from Old Tom as well, and had also worked for Forgan aand Company. An excellent player, he and Robert had had many great matches over the Old Course. Arriving in this country aboard the SS Umbria out of Liverpool on March 11, 1895, it wouldn’t take long for the 24-year old to quickly make his mark. Jim immediately traveled to Chicago where he became the first golf professional at Chicago GC, and the first golf professional in the western United States. (Feature Interview with Jim Healey. July 2003. HERE) ... ""

MooPig City Desk Department :: "Those Loathsome Republicans"

Self-loathing Seminars Available
Retrieved by Pat Darnell | Jan 20, 2013 | Bryan TX

[Picture LINK]

Obama won the popular vote with 65.9 million votes, or 51.1 percent, to Romney’s 60.9 million, or 47.2 percent, and won the Electoral College by a wide margin, 332-206 electoral votes.

There are other signs that Republican state legislators, governors and veteran political strategists are seriously considering making a shift, as the GOP looks to rebound from presidential candidate Mitt Romney’s Electoral College shellacking and the demographic changes that threaten the party’s long-term political prospects.  (HERE)

Among the motivational speakers invited to address the retreat is Erik Weihenmayer, the first blind man to climb Mt Everest and thus the perfect person to inspire Republicans as they grope their way towards the heights of government. (HERE)

Republicans Retreat To Reassess and Figure Out How to Talk to Negroes and People With Lady Parts | Common Dreams: "Republican lawmakers have gathered in Williamsburg, Virginia to consider their political past (not so rosy) and future (not so rosy either), discuss topics from the debt ceiling and gun control to how to game the electoral college, and attend seminars titled "What Happened and Where Are We Now?" (good question!) ...

"How Is America Changing?" and "Successful Communication with Minorities and Women" - the last held in the Burwell Plantation Room, so named for a fine old slave-owning family, and located in the tony Kingsmill Resort, site of another fine old slave plantation.

Presumably, breakout sessions will include do's and don'ts on nappy hair and how to distinguish from illegitimate, oh-really-it's-nothing rape and actual, maybe-this-is-not-so-okay rape-rape, which the three white men and two women on the panel can hopefully figure out."

'via Blog this'

Rep. Greg Walden, R-Ore., who heads Republicans' campaign efforts, deflected a question regarding the irony of a panel trying to help the GOP woo minorities happening in a room named after a slave-owning family’s plantation.

"I don't pick the rooms we meet in," Walden said. "I know the Democrats have held their retreats here too and I assume you'll go and figure out if they ever held meetings in that same room."

When pressed on why there were three white men (half the group) on a panel regarding minority outreach Walden said, "Actually, I don't do this part of it, by the way, somebody can fill you in on all the names, but it is more than just three white guys on the panel, and it was filled out after that went to press."

Walden made known that minority outreach and recruiting minority House GOP candidates were a “top priority” and that the GOP had a “good message” for minorities but had suffered from a recent "bad communications." (Luke Russert and Frank Thorp, NBC News. 2 days ago. HERE)

[Picture LINK] ... The resort was once the Kingsmill Plantation.

Panels will take place in the resort’s “Burwell Plantation” room, named after the family that once owned the plantation. The luxury resort is now owned by billionaire Philip Anschutz, a conservative political donor.

MooPig Speech Templates :: "I was Wrong and Foolish -- I felt Entitled...." Love, Tiger

Use Tiger Woods' Speech as a Prompter Template in your Dag-nab'bit Apology for Latent Lasciviousness
Retrieved HERE by Pat Darnell

VIDEO HERE, ... and following is Tiger Woods' statement [transcript] in its entirety:

[ ... ]

“Good morning. Thank you for joining me. Many of you in this room are my friends, and many in the room know me, and many of you have cheered for me or you worked with me or you supported me. Now, every one of you has good reason to be critical of me. I want to say to each of you, simply and directly, I am deeply sorry for my irresponsible and selfish behavior I engaged in.
“I know people want to find out how I could be so selfish and so foolish, and people want to know how I could have done these things to my wife, Elin, and to my children. And while I have always tried to be a private person, there are some things I want to say. Elin and I have started the process of discussing the damage caused by my behavior. As Elin pointed out to me, my real apology to her will not come in the form of words. It will come from my behavior over time. We have a lot to discuss. However, what we say to each other will remain between the two of us.
“I am also aware of the pain my behavior has caused to those of you in this room. I have let you down. I have let down my fans. For many of you, especially my friends, my behavior has been a personal disappointment. To those of you who worked for me, I have let you down personally and professionally. My behavior has caused considerable worry to my business partners. To everybody involved in my foundation, including my staff, board of directors, sponsors and most importantly the young students we reach, our work is more important than ever. Thirteen years ago, my dad and I envisioned helping young people achieve their dreams through education. This work remains unchanged and will continue to grow. From the learning center students in southern California to the scholars in Washington, D.C., millions of kids have changed their lives and I am dedicated to making sure that continues. But still, I know I have bitterly disappointed all of you. I have made you question who I am and how I could have done the things I did. I am embarrassed that I have put you in this position. For all that I have done, I am so sorry. I have a lot to atone for.
“But there is one issue I've really wanted to discuss. Some people speculated that Elin hurt or attacked me on Thanksgiving night. It angers me that people would fabricate a story like that. Elin never hit me that night or any other night. There has never been an episode of domestic violence in our marriage, ever.
“Elin has shown enormous grace and poise throughout this ordeal. Elin deserves praise, not blame. The issue involved here was my repeated irresponsible behavior. I was unfaithful. I had affairs. I cheated. What I did is not acceptable, and I am the only person to blame. I stopped living by the core values that I was taught to believe in. I knew my actions were wrong, but I convinced myself that normal rules did not apply. I never thought about who I was hurting. Instead, I thought only about myself. I ran straight through the boundaries that a married couple should live by, and I thought I could get away with whatever I wanted to. I felt that I had worked hard my entire life and deserved to enjoy all the temptations around me. I felt I was entitled. Thanks to money and fame, I didn't have far...I didn't have to go far too find them.
“I was wrong and I was foolish. I don't get to play by different rules. The same boundaries that apply to everyone apply to me. I brought this shame on myself. I hurt my wife, my kids, my mother, my wife's family, my friends, my foundation, and kids all around the world who admired me. I have had a lot of time to think about what I have done. My failures have made me look at myself in a way I never wanted to before. It's now up to me to make amends, and that starts by never repeating the mistakes that I have made. It's up to me to start living a life of integrity. I once heard, and I believe it's true, it's not what you achieve in life that matters, it's what you overcome. Achievements on the golf course are only part of setting an example. Character and decency are what really count. Parents used to point to me as a role model to their kids, and I owe all those families a special apology. I want to say to them that I am truly sorry. It's hard to admit that I need help, but I do. For 45 days from the end of December to early February, I was inpatient therapy receiving guidance for the issues that I am facing. I have a long way to go. But I am taking my first steps in the right direction.

“As I proceed, I understand people have questions and I understand the press wants to ask me in detail for the times I was unfaithful, and I understand people want to know whether Elin and I will remain together. Please know as far as I am concerned, every one of the questions and answers is a matter between Elin and me. These are issues between a husband and a wife. Some people have made up things that never happened. They said I used performance enhancing drugs. This is completely and utterly false. Some have written things about my family. Despite the damage that I have done, I still believe it is right to shield my family from the public spotlight. They did not do these things. I did. I have always tried to maintain a private space for my wife and children. They have been kept separate from my sponsors and my commercial endorsements. When my children were born, we only released photographs so that the paparazzi could not chase them. However, my behavior doesn't make it right for the media to follow my 2 1/2-year-old daughter to school and report the school's location. They staked out my wife and pursued my mom. Whatever my wrong doings, for the sake of my family, please leave my wife and kids alone.

[Video at 13:25 BUDDHISM]  -- YIKES !!
“I recognize I have brought this on myself. And I know, above all, I am the one who needs to change. I owe it to my family to become a better person. I owe it to those closest to me to become a better man. That's where my focus will be. I have a lot of work to do. I tend to dedicate myself to doing it. Part of following this path for me is Buddhism which my mother taught me at a young age. People probably don't realize it but I was raised a Buddhist and practiced my faith until I drifted away from it. This teaches me to stop following every impulse and to learn restraint. Obviously, I lost track of what I was taught.
“As I move forward, I will continue to receive help because I have learned that's how people really do change. Starting tomorrow, I will leave for more treatment and more therapy. I would like to thank my friends at Accenture and the players in the field this week for understanding why I am making these remarks today. In therapy, I have learned the importance of looking at my spiritual life and keeping in balance with my professional life. I need to regain my balance and be centered so I can save the things most important to me, my marriage and my children. That also means relying on others for help. I have learned to seek support from my peers in therapy and someday hope to return that support to others who are seeking help.
“I do plan to return to golf one day. I just don't know when that day will be. I don't rule out that it will be this year. When I do return, I need to make my behavior more respectful of the game. In recent weeks, I have received many thousands of e-mails, letters and phone calls from people expressing good wishes. To every one who has reached out to me and my family, thank you. Your encouragement means the world to Elin and me. I want to thank the PGA tour, the commissioner and the players for their patience and understanding while I work on my private life. I look forward to seeing my fellow players on the course. Finally, there are many people in this room and there are many people at home who believed in me.
“Today I want to ask for your help. I asked you to find room in your heart to one day believe in me again. Thank you.”

Jupiter Dust Filtration System: Winter 2007

ACCRETION OF MASS

External accretion of extraterrestrial mass is irrefutable. Everyone knows about meteors and meteor showers that regularly enhance the night skies at certain times each year. Meteorites, the solid remnants of meteors that land on Earth, are also known to almost everyone, even though few may have actually seen one. (SOURCE)

W. K. M. Rice, Philip J. Armitage, Kenneth Wood, and G. Lodato, Monthly Notices of the Royal Astronomical Society, 373 1619-1926 (2006).

When astronomers observe a star surrounded by an accretion disk in visible light, they typically see radiation from the star at the center of the disk. When they observe the disk in the infrared, they typically see emission at a continuous range of wavelengths, ranging from short to long. The short-wavelength IR radiation emanates from dust closest to the star. There the dust is heated to temperatures of a 1000 °C or more. Dust in the disk farther away from the star is cooler and emits at longer IR wavelengths.

The problem is it's virtually impossible to actually see a nascent planet inside a swirling, turbulent, and opaque disk of gas and dust. It's much easier to identify planets orbiting stars a billion years old (or older) whose accretion disks have vanished.

Not ones to throw up their hands in despair, however, Fellow Phil Armitage and colleagues from the University of Edinburgh, the University of St. Andrews, and Cambridge's Institute of Astronomy recently analyzed some indirect evidence that some accretion disks may have at least one Jupiter-sized gas planet within them. The evidence comes from the properties of the disk itself. (Read Article HERE)

Golf-Man hits a 'Hawk... or does he?

March 8, 2008

"My Brudda,
It sounds as if the hawk was taunting him. These duffer-style millionaires really ruffle my feathers, too. Eh?
See what you kids think, DD"

Dear Brudda DD Back:

Is this what FreeBird means? Seems odd though because that particular golfer rarely gets any birdies on tour. I sure hope no one is hurt!!

Readers, see what you think, could one golf ball take down a 'Hawk? ...or is it a grassy knoll style conspiracy?

Isenhour getting plenty of unwanted attention for hawk killing
By TRAVIS REED, Associated Press Writer Mar 8, 4:17 am EST

"...ORLANDO, Fla. (AP)—Tripp Isenhour has never gotten this much attention for a single golf shot. Really, he’s never gotten this much attention, period.... 'his first interview since the news was disclosed that he killed the hawk Dec. 12.' (AP)
[PHOTO: Around this time, December 7, 1941, Japanese attacked Pearl Harbor. Is this a reminder of the super power is sometimes vulnerable?]~~~~~~~}

"...Isenhour said it was a “one-in-a-million” golf shot that killed a protected hawk and that he was only trying to scare the bird he now faces misdemeanor criminal charges for killing.

PGA Tour players didn’t seem too shaken.

“It’s a bad break for the bird, but it sounds like there are a lot of other things people should be worried about,” Mark Calcavecchia said.

That’s obviously people who don’t know very much about golf,” he said. “To say it’s a one-in-a-million shot for an accident like that to happen, you know, and when it did happen, I was very remorseful, very upset that it happened.” ..."

But film crew members who witnessed the killing saw it differently. ..."

“He was just going strangely out of the way to go after it,” said Jethro Senger, a sound engineer at the shoot. “And it was almost, the whole thing was basically like a joke to him. The balls were getting closer and closer...

‘Haha, look how close that one came.’

‘That one was even closer.’..." OOpppps! Wrong pictures.... below is the corrected images.

Wow; I feel safer now!

Golfer Explains the Killing of a Hawk:

"Tripp Isenhour said that it was a “one-in-a-million” golf shot that killed a protected hawk and that he was only trying to scare the bird he now faces criminal charges for killing.

"He spoke on the Golf Channel’s PODS Championship postround show Friday, his first interview since the news was disclosed that he killed the hawk Dec. 12.
"Investigators say Isenhour became upset because the hawk’s loud chirps interrupted the filming of his
instructional video. He was charged Wednesday in Orange County Circuit Court in Florida with animal cruelty and killing a migratory bird, charges that carry a combined 14 months in jail and $1,500 in fines."

GPS, Golf Carts, Distance to the Hole....and a Whisper

When I was a little boy, my daddy took me to Herman Park where he teed off with three others on a Saturday morning at least once a month. I was his caddy. I pulled the bag cart and tried to keep up, that was my task. I always got to have an Orange Nehi bottled soda at the start of the back nine, at 8:30 in the morning.

Too bad there is no narrative in literature for the years between 1 through 11. That is because all memories from then are in images, and sensations, and pictographs.

Can you relate? Sort of a self-speak, creates fillers when there is little going on upstairs.

So yesterday while I was doing nothing, it popped in my head, "Hey, distances.... to the hole.... which iron? ........GPS!"

"The ProShot Golf Traditional GPS system, in its simplicity, keeps with the traditional mind-set prevalent in the golf industry by keeping the golfer focused on his game. The system steers away from offering the bells and whistles that our competition feels a player needs to play his game, when in fact they only serve to distract a player and ultimately decrease your course?s pace of play.
The ProShot Golf Traditional GPS system is a steering column-mounted unit that is un-intrusive to the player?s line of site. Yardages to lakes, bunkers and other hazards, as well as to the front, center and back of the greens (accurate to within one yard) are readily displayed. In addition, pro tips are also provided to help the golfer make an informed decision of which club to use and what strategy to employ. Golfers can also get their drive distances if they choose. Ultimately, your golfers will leave your course with a more enjoyable overall golfing experience..." (www.proshot.com ).

So I thought I had a brain wave originating faroff away from the distant golf men who whisper to me still through the River Oaks of Houston. Hey I have a new gadget that my golfing friends will want for their plenary golf carts.
I even called Rick, who rebuilds g-carts and asked him if he installs GPS on the carts, "Huh?" he said.
"You know distance to the hole and picking your club?" I said. Then I remembered he doesn't play golf. "Okay, I'll get back to you. I haven't researched it yet."
Who am I kidding?
Well, that was yesterday afternoon. Google came up with about 1,320,000 hits for gps, golf, distances. in (0.12 seconds). So I felt the usual foolish and pound pour idiot with an idea. Can I get a witness?

Legal Framework Essay: Making a Mole hill out of a Sand trap

Americans with Disabilities Act Case Study: Golf Handicaps
By Patrick Darnell

The Legal and Ethical Environment of Business

Read the case and discuss the outcome of the case, whether the holdings of this case could lead to unlawful excuses for discrimination in other settings and/or against other classes, and the ethics of incorporating the principles of this case into DWIInc's EEO/ ADA policy book and training manual. (Task Detail; 2006)

Introduction Golf man: Leveraged Leisure-tronics Case Study
A very broad discussion of ADA: in context of Reasonable Accommodation by Employers as required by Americans with Disabilities Act is reviewed here. Concerning application of Americans with Disabilities Act of 1990, to a consequence of nature: “first, whether the Act protects access to professional golf tournaments by a qualified entrant with a disability; second whether a disabled contestant may be denied the use of a golf cart because it would ‘fundamentally alter the nature’ of the tournaments.”

The vernacular of golf is fully bound in traditions and fairness of centuries of play of the sport. Today, in highest level of play there is the test of a regulation official tournament play called the “Q School” of sponsored competition.

The Public is allowed to visit sites of play, and watch four rounds of weekend golf from Thursday to Sunday. Golf carts as a mode to ambulate a course on the last two days is forbidden since 1997, in spirit of “starting from a completely equal point of departure for all the highest level qualifying players.”

That all said: 100 plus years history of golf has witnessed many modifications in equipment. The modifications will have transpired in more efficient equipment and mechanical modes of ambulation. Additionally, at present commerce power of golf in the USA affects 25 million golfers, with the four day tour generating approximately $300 million per tournament. Reason of existence is not about equipment, rather the rules of fairness, so says the petitioners and the dissenting judges.

“The basic rules of Golf, the hard cards, and the weekly notices, apply equally
to all players in tour competitions. ‘The Masters’ Tournament which is golf at
its very highest level ...the key is to have everyone tee off on the first hole
under exactly the same conditions and all of them be tested over 72-hole event
under the conditions that exist during the four day event" (Stevens, May 29,
2001).

Thus, first theory: Can equal play be affected by irregular modifications?

Equal play >> (not the same modifications)
(Not the same modifications) >> equal Odds
Equal odds >> equal play
In a self-sacrificing society like in the USA, what are odds of having a one good-legged golfer qualifying as a highest level golfer out of 25 million golfers? The odds are pretty against having high rankings, considering rarity and difficulty in having only one leg.

Also, what are odds of equal modifications in ranks of professionals, with some portion of $300 million per tournament at stake? That dollar figure is from not only commercialization, but in endorsement of TV exposure of garments and golf gewgaws that Professionals use in tournament.

Someone, someday in a high level future golf tournament is going to have only one good leg and uncanny modifications to help him or her walk or ride the course, regardless the odds of equanimity. And all those gizmos will be for sale at your local retailers’ after seeing them on TV all weekend.

A Legal Framework
The professor teaches that the framework is enticingly familiar in each case of petition against modification of rules, in the presence of extra high commerce. Professor asks: “Is it legal; is it ethical; is it good for the whole?” Society at large is not selfless, rather motivated.

“Whether happenstance events are more or less probable than the likelihood that a golfer afflicted with Klippel-Trenaunay-Weber Syndrome would one day qualify for the NIKE Tour and PGA Tour, they at least demonstrate that pure chance may have a greater impact on the outcome of elite golf tournaments than the fatigue [pain differential]resulting from the enforcement of the walking rule (Pg. 9, of 27)

Theory two: Is golf a Game of odds with many variables? Consider this flow chart:

Equal play >> Golfer >> one-legged handicap >> chance to make good Tee off >> chance to make good, efficient, shots to hole >> chance to sink ball in hole >> chance to make fewer shots than competing high level golfers >> qualifying for PGA... For goodness sakes

...Just qualifying for PGA = equal play

Discussion of the Case
The court case of PGA Tour vs. Casey Martin, the petitioner came to illogical conclusion based on the negative of irregular modifications we see in the first theory. Our handicapped golfer, C. Martin, with one good leg, qualified as a cart rider golfer. He could not compete per the rules of no carts in final rounds. The petitioner thought: “The essence of the rules of highest level of golf was smeared, the rules were stretched, and the selflessness of equal competition became biased.” Legally, the petitioner is correct; C. Martin does not qualify for the job of walking “hard card” finalist. “To be sure, waiver of an essential rule of competition for anyone would fundamentally alter the nature of petitioner’s tournaments.

In context of the second theory above: Was it ethical to let C. Martin golf in the finals? In context of pain differential to play in the finals, Martin who cannot walk the course will be in a similar amount of fatigue in the course progression as the fatigue of those who walk.
Get it? The golf cart is a high tech crutch for a severely handicapped, disabled athlete, as much as a “Carbonized Max Aluminum-Headed Driver golf club” is a crutch to the less strong player, who can putt, but cannot drive. Modifications are arbitrary.
Discussion: ADA -- Title III of the ADA prescribes as a general rule

“No individual shall be discriminated against on the basis of disability in the full and equal enjoyment of the goods, services, facilities, privileges, advantages or accommodations of any place of public accommodation by any person who owns leases sub-lets, or operates a place of public accommodations (42 USC 12182).”

Please note that “public accommodations have been defined in terms of 12 categories,” and includes specifically “golf courses (footnote 24, id).”
Is the modification good for the stakeholders?
The stakeholders are mentioned as both the owners of the golf course and the highest level players competing in the tournaments. The chance to view the event both live and on TV makes the commerce power limitless. Therefore, what’s good for the golfer [could be] what’s good for the public [could be] what’s good for the golf course owner.
I think that is why courts ruled against walking rule of the petition. “The walking rule that is contained in petitioner’s ‘hard cards’ based on an optional condition buried in an appendix to the Rules of Golf is not an essential attribute of the game of golf.”
Summary of Case Context Discussion: Fairness
In aftermath of court tested petitions, we the patrons, the curious and genuinely strident are left with the opinion of the court to read and ponder in secondary research. To guide oneself through tides of opinion, to gain a smidgeon of knowledge depends on questions asked, and applications of ethics, morals and values, in answering those queries.
It never ceases to amaze what lengths Americans will go to determine effects laws have on the individual. The entire lengthy debate in the record focuses on consequence of participants, spectators, and owners of events, to determine fairness to all.
How can the ADA be applied to this and other cases?
“Its application to petitioner’s tournaments cannot be said to be unintended or unexpected [because] even if it were, ‘the fact that a statute can be applied in situations not expressly anticipated by Congress does not demonstrate ambiguity. It demonstrates breadth.” (Pennsylvania Dept of Corrections v Yeskey, 524 US at 212)
“But surely, in a case of this kind, congress intended that an entity like the PGA not only give individualized attention to the handful of requests that it might receive from talented but disabled athletes for a modification or waiver of a rule to allow them access to the competitions, but also carefully weigh the purpose, as well as the letter, of the rule before determining that no accommodation would be tolerable Justice Stevens; May 29, 2001).”
Conclusion: Personal Opinion on Proportion
The Appellate Court posted no opinion. My opinion is this: both the employee and employer now have the burden of tweaking every job description and job design. No more can the subjective rule of thumb be used to identify and promote employees. I believe the commerce power over rode the rules in this case, but the summaries were split.

Thus, a once successful golfer who has unfortunately lost use of one leg could pose a certain hazard or danger to himself and the assembled at the work-place. If the golfer is leaving tire tracks all over the course, and injury occurs because the other golfers find swooshed turf in the fairway, and thus lose strokes, then the context of diversity compliance in the workplace is defeated. The warranted core competency of the company is compromised.
