Bryan police said Thursday that they had warrants out for two men whom they believe provided the alcohol that contributed to the fatal crash in which three teens died Aug. 3.
Carroll Wayne Dicky Jr., a 21-year-old brother of one of the accident victims, and Jimmy Luis Noey Jr., 21, both will be charged with making alcohol available to a minor, which is a Class A misdemeanor punishable by up to a year in jail and a $4,000 fine.
Assistant Chief Curtis Darby said Dicky is in jail on unrelated charges so the warrant will be served there. Noey's attorney had been contacted and said Noey would be turning himself in to the police station Friday morning.
Normangee brothers Gus Benavides, 18, and Dillon Benavides, 16 and 15-year-old Alex Dicky were involved in a crash after obtaining alcohol at a Sweet 16 party, Darby said.
The teens had been riding in a 2006 Mazda RX8 when it burst into flames after crashing into a tree around 4 a.m., police said.
The driver, Dillon Benavides, had a blood alcohol content level of .12, according to a medical examiner's report. It is illegal to drive with a blood alcohol content of .08 or more.
Detective Lori Berndt said the biggest obstacle that past month in getting to the bottom of the case, was getting the half a dozen or so people they interviewed to cooperate.
"We could have solved this within a week," Berndt said.
